These Terms & Conditions apply to use of the EVO FITNESS website and to membership and facility access at Evolution 24/7 Gym, 385 South Gippsland Highway, Dandenong South VIC 3175 Australia. By using the site, joining, or entering the facility, you agree to these terms. This page is a general starting template and is not legal advice.

Membership and 24/7 access

Membership details, fees, and start dates are confirmed when you join. 24/7 access depends on a valid membership and any access credentials we issue. You must not share fobs, PINs, or other access details. You are responsible for how your credentials are used.

• Train only in designated zones and follow posted facility rules
• Use equipment safely and re-rack plates, dumbbells, and accessories
• Do not admit non-members through the access gate
• Leave the facility if asked by staff or if your membership is suspended

Health, safety, and your responsibility

Gym training involves inherent risk of injury. You should not train if you are unwell or if a health professional has advised you not to exercise. You are responsible for using equipment correctly, training within your ability, and seeking medical advice where needed. We are not a medical provider.

Australian Consumer Law

Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law (ACL) or any other law that cannot be excluded. Where we are allowed to limit our liability for a failure to comply with an ACL guarantee, our liability is limited to resupplying the services or paying the cost of having the services supplied again.

Liability

To the extent permitted by law, EVO FITNESS is not liable for loss or damage arising from your use of the facility, equipment, or 24/7 access, except where caused by our negligence or a non-excludable statutory obligation. You must take reasonable care for your own safety and the safety of others on the floor.

Conduct

We may refuse entry, suspend access, or end a membership if you damage property, harass others, breach access rules, or use the facility in an unsafe or unlawful way.

Governing law

These terms are governed by the laws of Victoria, Australia. Courts in Victoria have jurisdiction, subject to any non-excludable rights you have under Australian law.
